Nurmi is arguing that the photo shows Arias was holding the camera in the way she said she was, with both of her hands on the camera from a few feet away, and that somehow proves that her testimony was truthful. If she lets it in, then the Evidence Rules on expert testimony are worthless. Really did he say the prosecutial misconduct is an accumulative problem?? He is so reaching. He is ridiculous. Apparently we are back to the Martinez misconduct motion. I thought they were moving on to the Alyce stuff but they are not. We are back to the mistrial motion that states the defense cannot give adequate counsel because Martinez has demonstrated misconduct. The misconduct is not just the photos and autographs.

There are two motions it seems the second one has to do with Martinez harassing witnesses, specifically Dr Samuels during the trial. Looks like Alyce is off the hook and Juan is on it. Juan has asked for a ruling on the Wong hearing. He wants to separate the hearing about photos and autographs from the one about him intimidating the witnesses.

So it appears that Nurmi is arguing his points to the judge about Wong. Juan says that these are two different issues. The photo and the witness intimidation issues are unrelated.

He says that the defense wants to say that this is effecting the juries. We have already interviewed the jurors and know they were not affected. He says except for the defense counsel can add a few extra pennies to their pockets. Nurmi is bitching back. The judge has denied the mistrial. Mistrial is the most dramatic remedy and the court cannot make that finding. We are moving on to the witness intimidation hearing. Thank God. Nurmi is arguing that Martinez was threatening or intimidating I missed the exact wording toward Alyce in Chambers regarding her being stalked or harassed by the public.
